Every DUI carries mandatory minimums under Arizona law. Judges have little flexibility without a proper legal basis. That is why challenging the stop, testing, or procedures can make all the difference.

What are the DUI Penalties in Arizona?

Standard DUI – A.R.S. § 28-1381

  • First offense: at least 10 consecutive days in jail, though a judge may suspend all but one day with timely screening and treatment.
  • Minimum $250 base fine plus mandatory surcharges and assessments.
  • Ignition interlock required if alcohol is involved.
  • Second offense: at least 90 days in jail, 30 of which must be consecutive, plus community service, fines, and a one-year license revocation.

Extreme and Super Extreme DUI – A.R.S. § 28-1382

  • Extreme DUI (BAC .15 to < .20): minimum 30 consecutive days in jail, plus fines, assessments, and interlock.
  • Super Extreme DUI (BAC .20+): minimum 45 consecutive days in jail, higher fines, and interlock.
  • Second extreme offense: enhanced jail, higher fines, and a license revocation.

Aggravated DUI (Felony) – A.R.S. § 28-1383

A DUI becomes a felony when:

  • It is the third DUI within 84 months.
  • The driver’s license was suspended or restricted.
  • A child under 15 was in the car.
  • Interlock requirements were violated.
  • The driver was traveling the wrong way.

Convictions include mandatory prison terms in many cases, substantial fines, and license revocation.

MVD Administrative Action – A.R.S. § 28-1385

  • MVD can impose a 90-day suspension separate from any court case.
  • Many first-offense drivers may serve 30 days full suspension followed by 60 days restricted driving with treatment and interlock.
  • You must act quickly to request a hearing or summary review.
